Terms & Conditions for Territory Insights by GNB Habitat
1. Introduction and Acceptance:
Territory Insights ("the Service") is a proprietary product provided by GNB Habitat ("the Company" or "We"), offering detailed property market insights and data analytics services specifically designed for estate agents in the UK. It serves as an on-market prospecting tool aimed at generating new instructions and increasing market share for estate agents. Accessing or using the Service signifies your agreement to these Terms and Conditions ("Ts&Cs").
2. Definitions:
- "Service" refers to the online platform provided by GNB Habitat, including all content, tools, reports, and services offered through the website and related mobile applications, aimed at providing market analysis, data analytics, and reporting tools specifically designed for property professionals and estate agents.
- "User" or "You" refers to any individual or entity that accesses or uses the Service, including estate agents, property professionals, and any personnel authorised by an entity to use the Service on its behalf.
- "Content" encompasses all materials made available through the Service, including but not limited to data, reports, analytics, text, graphics, images, software, audio, video, and any other materials provided by GNB Habitat or its third-party partners.
- "User Content" means any data, information, content, or materials that Users submit, post, or otherwise provide to the Service, including property listings, photos, descriptions, user comments, and feedback.
- "Subscription" denotes the agreement between the User and GNB Habitat granting access to the Service for a defined period, subject to the payment of fees and compliance with these Terms and Conditions.
- "Confidential Information" includes any proprietary data, trade secrets, software, specifications, manuals, business plans, software, marketing plans, financial information, and other information disclosed or submitted, orally or in writing, by one party to the other in connection with the Service, which is designated as confidential or which reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure.
- "Intellectual Property Rights" refers to all copyright, trademarks, patents, trade secrets, and any other proprietary rights associated with the Content, User Content, and any other materials provided or made available through the Service.
3. Services Offered:
Subscribers to Territory Insights can:
- Access detailed property reports by postcode.
- Monitor property listings, status, price changes, and agent movements.
- Create and send bespoke and branded direct mail campaigns through our software, leveraging the data and insights gathered to target specific audiences effectively.
- Export data to further customise and analyse for direct mail campaigns or other marketing purposes.
- Purchase landlord information directly from the dashboard, integrating with Land Registry. The Service is provided via a website, enhancing user experience and accessibility, with features designed to support property professionals in their marketing and analysis efforts.
4. Account Creation and Management:
- To leverage the Service, you are required to create an account, ensuring the provision of accurate, complete, and up-to-date information. Failure to adhere to this requirement constitutes a violation of these Terms, potentially leading to the immediate termination of your account. You bear full responsibility for maintaining the confidentiality of the password associated with your Service access and for all activities conducted under your account. Disclosure of your password to any third party is strictly prohibited. Immediate notification to us is mandatory upon any realisation of unauthorised account use or any security breach.
5. Subscription, Pricing, and Payment:
The Service offers a standalone subscription model:
- Territory Insights costs £50 per week. However, for a limited time, we offer a special launch price of £20 per week. Plus, you get the first 7 days free! After your free period, enjoy the continued rate of £20 per week on a rolling monthly basis with no contract—cancel anytime.
- Each subscription grants access to reports for up to 5 postcodes. For expanded coverage, additional postcodes can be added at a cost of £5/week + VAT per new postcode at the time of addition. Subsequent billing will be based on the total number of active postcodes at the time of each billing cycle.
- To cancel, you can do so anytime via your account settings or by emailing us. Ensure you allow enough time for processing before your next payment if done via email.
- Subscription fees may be modified with reasonable notice, and continued use after changes indicates agreement to the new fees.
6. Credit System for Postage, Fulfillment, and Land Registry Information:
Our service incorporates a credit system designed to facilitate the efficient use of our postage and fulfillment services and for the purchase of Landlord deeds via Land Registry information. This system allows estate agents to tailor their use of our services to their specific needs.
Purchasing Credits
- Availability: Credits can be purchased directly through the software, providing estate agents with the flexibility to access our postage and fulfillment services or to acquire Landlord deeds as needed.
- Packages: To accommodate different levels of need, we offer four distinct credit packages:
- Starter Pack: 100 credits for £50
- Accelerator: 250 credits for £125
- Market Dominator: 500 credits for £250
- Elite Performer: 1000 credits for £500 (Note: Prices exclude VAT. Credits purchased are refundable and never expire, but promotional credits are non-refundable.)
Usage of Credits
- Postage and Fulfillment Services: Credits can be used to cover the costs associated with the postage and fulfillment of letters, enabling estate agents to seamlessly manage their direct mail campaigns.
- Landlord Deeds: Additionally, credits can be utilised to purchase Landlord deeds via Land Registry, providing valuable property ownership information essential for comprehensive market analysis and prospecting.
Refunds and Expiry
- Refundable: In the event that estate agents have unused credits, these credits are refundable, offering a level of financial flexibility and security.
- No Expiry: Credits purchased through our service do not expire, ensuring that estate agents can use them as needed without concern for losing their value over time. This credit system is designed to enhance the usability and flexibility of our services, ensuring that estate agents can manage their campaigns and information needs efficiently and effectively.
7. Area Exclusivity
- The Service is non-exclusive to any specific area, thereby permitting multiple agents to utilise the Service within identical regions.
8. User Limitations:
- Users are restricted from using the service in a way that is unlawful, infringes on others' rights, or is prohibited by these terms. Subscriptions are not subject to a limit on the number of users. Subscribers may grant access to their subscription to multiple users within their organisation, ensuring a flexible and collaborative approach to utilising the service. Despite the absence of a user limit, subscribers are expected to manage access responsibly and ensure that all users adhere to the terms and conditions set forth, maintaining the integrity and security of the service.
9. Subscription Renewals, Cancellation, and Refunds:
- Our service operates on a monthly subscription basis, with no contracts, allowing for monthly rolling subscriptions that automatically renew. Users wishing to cancel must provide enough time for processing via email to helpdesk@gnbhabitat.com. Cancellations part-way through a billing cycle will not result in a refund for the remaining days.
10. Direct Mail Service:
- Delivery Speed and Quality: Our mail is dispatched via Royal Mail 2nd class, aiming for delivery within 2-3 working days. All letters are printed in colour on high-quality 100gsm A4 paper.
- Brand Protection: We ensure no mailings to properties listed with multiple agents or your own listings. Additionally, we avoid repeat communications to the same prospect within a 7-day period, allow blacklisting of addresses, and offer a 24-hour cancellation window for letters. Customise your letter branding and content to match your brand perfectly.
11. Modification of Subscription Fees:
We hold the authority to adjust the subscription fees for the Service at any moment, ensuring reasonable advance notice to users. Fee adjustments will take effect following the conclusion of the current billing cycle. Continued use of the Service post-fee adjustment implies your acceptance of the new fees.
12. User Obligations, Restrictions, and Conduct:
- Users must not share or redistribute Content and are limited to one device access at any time. Standards of behaviour must be maintained, and any form of harassment, misrepresentation, or unauthorised access will result in termination.
13. Intellectual Property and Feedback:
- All Content related to the Service is copyrighted. Feedback provided by users can be utilised by the Company without obligation. Users retain rights to their generated content but grant a license for its use in providing the Service.
14. Data Protection, Privacy, and Security:
- Compliance with GDPR and leading cybersecurity practices ensure user data is secure and encrypted. Data sharing requires user consent, detailed further in our Privacy Policy.
15. Termination Policy:
- We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including any breach of these Terms. Termination will result in the immediate revocation of your right to use the Service.
16. Confidentiality:
- The software and any related documentation are considered confidential information. You agree to take reasonable steps to prevent the disclosure of this information without our prior written consent.

- Our Service may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, privacy policies, or practices of any third party websites or services.
18. Indemnification:
- You agree to defend, indemnify, and hold harmless GNB Habitat, its affiliates, and licensors from any claims, damages, liabilities, and expenses arising from your use of the Service or breach of these Terms.
19. Limitation of Liability:
- In no event will GNB Habitat be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, any third-party link, or any content obtained from the Service.
20. Disclaimer:
- The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not guarantee that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
21. Governing Law:
- These Terms shall be governed by the laws of England and Wales.
22. Force Majeure:
- Liability exemptions apply for events beyond reasonable control.
23. Changes to Terms
- We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to use the Service after these changes, you agree to be bound by the revised Terms.
